These Terms of Use ("Terms") apply to ellishomeremodeling.com and the online 3D Design Studio (together, the "Site"), operated by Ellis Home Remodeling Specialist ("Ellis," "we," "us" or "our") of Louisville, Kentucky. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Our services and your contract
The Site gives information about our remodeling, repair and outdoor services and lets you request an estimate. Any work we perform is governed only by a separate written proposal or contract signed by you and Ellis. These Terms do not create a contract for construction services, and nothing on the Site is an offer to perform work at a particular price.
Estimates and the 3D Design Studio
- Price ranges shown on the Site, including in the 3D Design Studio, are preliminary estimates for planning only. They are not quotes, bids or offers.
- Your final price is set in a written estimate after we visit the site, take measurements and confirm materials, access, permits and site conditions. It may be higher or lower than the online range.
- Designs made in the studio are visual concepts. They are not engineering drawings, are not drawn to construction tolerances and have not been checked for building codes, setbacks, HOA rules or permit requirements.
- Colors, textures and products on screen may look different in real life, and materials shown may not always be available.
AI features
Some features, such as the AI design assistant, use artificial intelligence. Their answers can be wrong or incomplete. Do not rely on them for structural, safety, electrical or code decisions. Confirm all details with our team before you make decisions about your project.
Information and content you send us
You agree that the information you submit is accurate and that you have the right to share any photos or files you send. You allow us to use what you send to respond to you, prepare estimates and provide our services. We will not publish photos of your home that you send through the Site without your permission. How we handle personal information is described in our Privacy Policy.
Acceptable use
Please do not misuse the Site. For example, do not:
- Break any law or use the Site to harass, deceive or harm anyone
- Submit false requests, spam or someone else's information without their permission
- Try to gain unauthorized access to the Site, its data or the staff dashboard
- Copy, scrape or resell the Site's content or software, or interfere with how it works
Our content
The Site, including its text, photos, logo, design and the 3D Design Studio software, belongs to Ellis or its licensors and is protected by copyright and trademark laws. You may use the Site for your own personal, non-commercial planning and may share links to it. You may keep and share designs you create for your own project.
Reviews and links to other sites
The Site links to third-party services, such as Google, Trustpilot, HomeAdvisor and social media. We do not control those services and are not responsible for their content or practices.
Disclaimers
The Site is provided "as is" and "as available." We work to keep it accurate and available, but we do not promise that it will be error-free, uninterrupted or free of harmful components. Warranties for construction work are only those stated in your written contract with Ellis.
Limitation of liability
To the fullest extent permitted by law, Ellis is not liable for any indirect, incidental, special or consequential damages arising from your use of the Site, and our total liability for any claim relating to the Site itself is limited to $100. This section does not limit our obligations under a signed contract for work, or any rights you have that cannot be limited by law.
Indemnity
If you misuse the Site or break these Terms, you agree to cover reasonable losses and costs that Ellis incurs as a result, to the extent permitted by law.
Governing law
These Terms are governed by the laws of the Commonwealth of Kentucky. Any dispute about the Site will be handled in the state or federal courts located in Jefferson County, Kentucky, unless the law requires otherwise.
Changes to these Terms
We may update these Terms from time to time. The date at the top shows when they last changed. Using the Site after a change means you accept the updated Terms.
